    Default Net Income calculations for child support

    For the purposes of calculating child supporticon (61.30), I understand that net income is obtained by subtracting allowable deductions from gross income. One of the allowable deductions is "(e) Health insurance payments, excluding payments for coverage of a minor child."

    I currently don't have any health insurance payments, because my health insurance is covered under the wife's benefit plan where she works. The moment there is a final judgement, i obviously will need to obtain my own health insurance that will then be available from my employer's benefit plan.

    Would the Health Insurance Payments that i would have within 30 days of the divorce be an allowable deductions from gross income? Likewise, can she use the payment amount that will in effect as the health insurance plan changes after the final judgment? It seems the new laws are designed to minimize the need for future litigation, and since that would make a substantial change I would think it would be allowed.

    It would be best to calculate child supporticon based on the new amount after taking into account your new health insurance costs after dissolution in order to have THAT child support calculation take effect on Final Judgment day.
