    Default Distribution of assets

    My husband and I have been married for 3 years. I supported him for the first 2. I had to take $6000 out of my 401K to bail him out of jail for non-child support payment. He is currently defrauding an insurance company by collecting disability and working 2 cash paying jobs.

    He moved out in Feb and has not given me any financial support. I only make $1200 a month and do not have enough money to live on. We don't have any children together. I purchased 2 motorcycles while we were married with money from my 401K. Both the motorcycles and my car are titled in my name only and insured in my name only. The whole time we were married, he abused drugs and used up all the money that I had saved before we got married.

    I borrowed $6000 to buy my car from a friend last year. Now I'm not able to pay her since he is no longer contributing to the household expenses. Can I give her one of the motorcycles to repay the loan? Also, can I sell the other one to have enough money to live on? I'm behind on my rent and every other bill because I'm not getting any financial assistance from my husband. He is already living with his girlfriend.

    I don't have enough money to hire an attorney unless I sell the motorcycle.

    Yes, my call is that you can sell or give away the motorcycles.
