me and my first sons legal father has been going back and forth to court for child support. he is in prison and will be there until 2012. this is my question he has never paid me a dime and he is in and out of jail and i wanted to know why is it that i cant get help with money from the government and he would have to pay it back? also he didnt even have to pay for the first year of my sons life, because he was in and out of jail before my case got taken into court. and i want to get married by next year to my fiance, he wants to adopt my son, so me and my son have the same last name as my other son and my fiance. but my first son has my last name not his legal fathers. now i want to know how can i get a judge say that my fiance can adopt?

That is complex. First you need to have the father's rights terminated. Call DCF for more info on that.
