My brother n law, has shared custody of a son with his ex. Ex has primary residencey. The father went and picked up child for a few weeks this summer. Yesterday the son's mother's bf's dad called the father of said child, told him that he just kicked out the child's mother andmothers boyfriend, as he caught them smoking dope. The boyfriend's father also told said childs father, that he has heard the boyfriend threaten to break the child's jaw. The boyfriend's father also noted that the mother and boyfriend just lock the child in his bedroom and will not allow him to play outside. The child is right now with my brother in law, and we have no idea where the mother is. What paperwork does the father of child need to do to take child out of harms way. Child is due to go back to the mother on sunday. However we have no idea where she is.

If they were divorced, he needs to reopen the divorce case and file a Supplemental Petition for modification.
