    Default Ex suing for custody/child support

    My son has been with me his whole life. Divorce finalized in 2003 gave me primary responsibilities. Jan. 2011 ex and I had conversation about son living with him. He verbally agreed and noted in conversation what he would expect. Son attended one semester of school where ex lives and then came home to me. He is now suing for custody and child supporticon from me. Son has been with me since June 10 (for summer visitation) and has expressed in several conversations that he does not want to live with father. I agreed and expressed to ex that I wanted to continue the way the original papers dictated. I responded to motion and would like to now amend. Mediation took place with no agreement. I would like to file amended motion to leave as original divorce papers state and to have child support reviewed. Do I take this action now or wait to see what type of paperwork comes from his attorney? Son is to start school on August on as currently stated is to be with me during school year.

    I would strongly suggest you spend a little money and have all the documents reviewed by an attorney. Even if you only have funds for "self-help", you need some initial guidance.

    This is a very technical area of law and what you do right now may limit your options later.

    Just an fyi, we would charge $145 for a review, and to discuss a do it yourself action plan.
