If he is absolutely not going to graduate by 19, child supportterminates on the 18th birthday.
Yes, you should still pay support while he is in jail.
I was divorced in Boynton Beach in 1998 but my ex-wife and 5 year-old son moved to NC in 1999 & live there still. My now almost 18 year old son was recently arrested for 2 counts of B&E, burglary & possession of stolen goods. His lawyer told him he might have some jail time as part of a plea. He won't be graduating from high school until next year (if ever by the way his grades look). I don't know what the plea might be, my son became very upset with me for not helping my ex-wife bail him out ($50K bond) so he stopped talking to me. I am currently remarried living in CT with a baby & mortgage I couldn't afford to help bail him out. If he gets incarcerated do I still pay support while he is in jail? What happens when he gets out? I have never missed a support payment in 13 years. Since neither my ex nor I ever had anything changed I'm assuming this still falls under Florida law. Thank you
