    Default Incarcerated Out of State child Custody

    My daughter's husband will be serving time in jail. She would like to move out of state and back "home" with her children. Planning to go to college and get a job there. Can she do this without any legal ramifications and is there anything legally she needs to do ahead of leaving?

    I assume she is not going to file for divorce?

    Yes, at the moment, she can move without legal ramifications. Of course he could hire an attorney and file for divorce. In that divorce case he could try to get the children forced back to their original area. But the chances of that while he is in jail are slim.
