    Default how to file a motion to have my divorce case heard sooner?

    I left my husband 2/14/11 after being married for only 5 months due to constant physical and verbal abuse. The day(2/14/11) i asked for a separation he threw hot coffee on me. He filed for divorce in April under adultery grounds and on the hearing date(7/29/11) the master said he didn't have sufficient evidence and postponed the case until 3/5/12. I want to file a motion to be heard based on cruelty. How to I do this?? Can I send in a motion to the court? I moved to Alaska and do not readily have access to the court in the county where we were married?

    Adultery and cruelty are not grounds for divorce in Florida. Those issues are not relevant. The most common ground for a Florida divorce is that the marriage is broken. You may want to wait until you qualify for divorce in your state. Otherwise, you will need to file a counter petition in the Florida case.
