    Default How long????????

    My ex filed a modificationicon of alimony in March 2011. He hasn't paid alimony which is permanent periodic since he retired early(55). He didn't have a court order to stop paying.I am going to have to get an attorney and file a MOC against him....Why does it take so long to get what is owed to you??Do I have to wait until I have a court date for the unpaid alimony,before I know if the judgeicon is going to modify or terminate my permanent periodic alimony?He started this will the judge make him pay my attorney fees and court costs...I don't have lots of money....So sad they can't use adultery against a person,not one but both the guilty parties...I had almost 3 decades invested in this marriage.

    You need to file a Motion for Contempt/Enforcement as soon as possible and send a copy to him (or his attorney if he has one now) as well as to the court. It is likely the judgeicon will hear both matters at the same time. The Judge will not hold him in contempt so long as there is an outstanding Supplemental Petition to Modify. You can argue that he voluntarily is unemployed but will have to show that in his line of work retiring at 55 is early...You can request attorney's fees and you should file a Motion for Temporary Attorney's Fees as well.
