    Question soon to be ex moves to NY, I'm still here in FLA, how will this work?

    My wife and I separated a couple weeks ago. She immediately took our son and went back to NY, she is not coming back. Now she is threatening court and child supporticon, if she were to file in a NY state court would I have to appear up there? would the laws be on New York's terms? I know Florida is a no fault state, but I don't think New York is, she cheated on me and I have proof, would it be better to get a lawyer and file in New York, or to just set it up here in Florida? Also a few people have been telling me she has abandoned me, what could I get out of that? since the only way I can see my son is if I visit.

    Last question: should I be talking to a divorce lawyer, or a child custody/support lawyer? I don't want custody, visitations are impossible on any kind of weekly or even monthly basis, I just want to make sure I don't get more taken from me in child support than is deserved. She quit her job about 5 months ago does that affect the final outcome?

    Sorry for the block of text, I need to set up a meeting with a lawyer and will but these questions have been really burning inside me, been keeping me up nights. Any answers this community can give will be GREATLY appreciated. Thank you.

    I cannot tell you anything about NY law. So if you want to decide which state is better, you need a consult with both a NY and a Florida attorney.

    Right this moment the state that has jurisdiction over your child is Florida. But is is extremely important that you do not delay legal action.

    A divorce attorney is also a custody and support attorney. The general area of family law includes all related matters.
