    Default Child Custody and Military

    Hi! The question I have or an insight would be most helpful.

    I have been divorced from my childs father and remarried as well as he has. We both have moved away from our original state, in which our divorce and custody arrangement was made. We now live here in FL, we have notorized copies of new arrangements we made but nothing has been filed anywhere. Our child resides with me, he sees her every other weekend and only because he lives 6-7 hours away. Next year we had the thought we would be able to move to the location he is in now. Fortunately/unfortunately we are Military, husband has been promoted and will not be retiring as we once had thought. My question is, how is FL and dealing with relocating with your child away from thier father to be with your new spouse that is getting orders to another area? We are prepared to hire an attorney but I havent found one yet. I do not want to take my child away from her father persay but I want her to experience different areas as we are greatly afforded by my husband serving this country. My x and I do not get along for many reasons, his new spouse has lost custody/signed over her children to their father and they will not tell me why. I know it may not be my business but my child is in this womens care and it isnt every day a mother signs over custody/loses cusotdy.

    Any help would be greaty appreciated. I know it sounds confusing. Thanks again

    It entirely depends on the judgeicon. I recently had a case where the judge thought the family had established a life as a military family - and that relocations had benefited the child.

    In general, the law is moving toward protecting military families. But again, it entirely depends on the individual judge.
