    Default Simple Divorce

    Hi, I have a friend who wants a simple divorce. The husband has two children that are not the wifes children. The Mother of the children died years ago. One child has already moved out and the other child is 16. The husband agreed to a simple divorce and there is one vehicle the wife drives and pays for but is in both names. The divorce petition and financial affidavits show the car will be the wifes after the divorce. The wife has moved out of the household with no warning to the husband becauses she was afraid of abuse. The paper work has been filed for the simple divorce at the courthouse. Now the papers are being served to the husband and the husband threatened the wife he will get an attorney and claim child abandonment and house abandment. She is leaving with nothing in her pockets and she wants nothing from him except the car she has been paying for since 2004. He has plenty of money and things to give but she wants nothing and only wants out of the marriage. Does the wife have anything to worry about with the threats from the husband with abandonment even though the children are not hers? She married in 2007 if that means anything.     She cannot legally abandon children that are not hers - nothing to worry about.

    No such thing as house-abandonment - again, nothing to worry about.
