    Default Marital Home - Who stays? Wife can't afford it husband can

    I am a stay at home mom to a 3 and 4 yr, our home was purchased for 880k with a joint mortgage of 640k. Question, we have agreed that I will have the kids most of the time so how can I stay in our marital home if I can't afford to pay the mortgage even with generous child supporticon? He wants to retain the house and have us move out.

    Facts:
    Their preschool and prek and activities are all in my area of town.

    You can ask the court to award you the right to remain in the home and ask for temporary spousal support. You have a short term marriage so it is unlikely you will get durational alimonyicon. If you cannot afford the home then you can see if the bank will allow you to refinance or do a loan modificationicon. You may have to relocate to another home in the same school district.
