    Question child. custody in common law marraiges in Florida.

    A female friend of mine has just decided to leave her sons biological father because of drug abuse on the side of both parties. They have a five year old son together. The mother just moved into my home and is now going to rehab to get rid of the addiction. The father will not release the child and states that if DCF is called that he and the mother will both.test positive for drugs. And will cause the child to go into states custody. The mother wants to have joint custody of the child and has no problem sharing custody of the child with the father. Now that the mother is in rehab and the father is not, is there a way for her to get custody? She is living in my home and there are other bedrooms available for the son. I am also supporting her financially. What should we do? Please help. I can't bare to see her without her child.

    If she is currently in rehab - now is not the time to take on that sort of fight.
