    Default False Financial Affidavit

    I filed for modificationicon/Termination of Permanent Periodic alimonyicon due to her $ignificant
    change in circumstance$. She filed a false Financial Affidavit, and (also) included
    fake 1040 Tax Returns. I haven't let on that I am aware of this.

    If I divulge this information at Mediation, can she amend the affidavit before trial and be
    off the hook for my attorney fees?

    A party is allowed to amend their financial affidavit throughout the proceeding and is required to do so. You can still argue that she misrepresented material information in her previous affidavit which was sworn to. In order to prove her documents are fake or false it would be wise to obtain the IRS documents she has filed.

    How does one legally obtain her IRS records without asking her for them ?
