    Default Recuse a Magistrate for bias

    Well just let my lawyer go for I am out of cash so pro-se but last time seeing my Lawyer he said if Magistrate signed interm report and recommedations without changes she could get recused i have filed my objection to the report with court prior to her signing (my lawyer gave me a copy with what should be taken out) so now comes finding the grounds has anyone be successful at this, she has been biased thru out. i have even taken a voluntarily psychological evaluation (there not happy) was then ordered to take one with who the court and GAL and wife's ESQ picked out. Filed motion to reconcideration on order of report and recomendation of GM this is alot of work now i understand why my bank is -0-

    Depending on if you follow the time sensitive requirements for filing Exceptions to the General Magistrate's report and recommendation you should be fine. The court will likely schedule a hearing in front of the judgeicon assigned to your case. If you have a concern about your judge or General Magistrate being biased you can file a Motion to Recuse that person based on your detailed reasons.
