Right of first refusal.

Is right of first refusal something that is usually granted? And if so, is it usually across the board or sometimes granted with "except summers" or "except" anytime?

Normally that is something that is negotiated. Some legal practitioners believe every agreement and order contains that right but I am not one of those people.
