    Default "expectation of privacy" as it relates to family law matters

    1.) Are conversations between spouses either in or outside the home,considered"private" conversations ?

    Florida Statute section 934.03. Under the statute, consent is not required for the taping of a non-electronic communication uttered by a person who does not have a "reasonable expectation of privacy" in that communication. However, this oral communication must be one that is made in a setting in which a person does not have a “reasonable expectation of privacy.” There are various circumstances when a person may not have a reasonable expectation of privacy.

    2.). Is it illegal for one spouse to protect ones self from false charge of making threats against the other spouse ?

    I think you are talking about secreting audio-taping? Yes it is illegal, even in a domestic setting.
