    Default is accusation of a threat likely to result in arrest and a restraining order ?

    If a spouse were to simply accuse the other of being threatened, absent any physical evidence other than one spouses word (assume wife) against the other (husband) with a minor child living in same home, could the husband be legally arrested and a restraining order issued preventing the husband from returning to the non-marital asset home ?

    Possibly a domestic violence injunction if that spouse is a pretty good liar and the judgeicon has a tendency to grant injunctions. But I doubt any sort of criminal charges would get filed. I also doubt an arrest would be made.
