    Default Filing Status for Tax Return

    My sister lives in Florida (Lee County) and filed for divorce on 6/10/11.
    She moved out of the house on 7/15/11.
    She has one child <18yrs old that moved with her.
    In regards to filing her Form 1040 for 2011, I'm inquiring as to the Filing Status she's eligible for seeing that Florida does not recognize a Legal Separation.
    According to state law, is she considered married or "legally separated"?
    IRS filing status for Unmarried individuals state that she can file either Single (no dependent), or Head of Household (dependent) "if he/she was unmarried or legally separated according to state law under a decree of divorce or separate maintenance at end of 2011".
    Or is she required to file MFJ?

    She can file Married Filing Separately
