Mediated Divorce -
Every attorney I have spoken too, requires a significant non-refundable retainer and describes the divorce process in terms of the "traditional" court path.
How do you obtain the services of an attorney to consult, advise, review and assess in order to determine if there are any elements of a Mediation Settlement Agreement that are "worse than your worst day in court" ? i.e., Your worst day in court, would not result in the outcome you've "negotiated" during Mediation.
I would hate to pay a non-refundable retainer of 3-5 thousand dollars, only to discover my spouse was completely reasonable and there was nothing disputable with their expectations and the Mediation Process consumes all of 2-3 hours.
Aren't there Attorneys who charge by the hour for legal consulting services rather than requiring a significant non-refundable retainer to review, advise and assess if the settlement output from Mediation is in the best interest of a client ?
i.e., Consult along the way, and ultimately make a determination if "even on my worst day in court, I would end up with a better outcome than that which is being proposed by mediation ?
