my husband and i have been married for going on 12 years we have 2 children together . in 2008 he moved us as a family to mississippi and two months later he abandoned me and the kids there. a year went by and me and the children went to florida for a visit BIG MISTAKE. his mom called dcf on me the first day we were there and then he went and filed a restraining order against me for him and the kids. the restraining order allowed no contact between me and the kids for 14 days. when we went to court he admited to the judge
that there was no domestic violence but he just wanted to make sure i couldnt leave the state with the children. the judge dimissed the restraining order but added a provision that stated i couldnt leave the state with the children. The judge didn't state this in court and his clerck says i was notified via regular mail at an adress i no longer lived at. my husband was constently stalking and harassing me and i didn't want to stay in fl and so me and the kids moved back to mississippi. that was over a year ago. he recently just got out of jail on his own recognasense for armed burglery. 2 days after he got out he went and filed against me for leaving and didnt show for the court date. thats how i found out about the provision . i wrote the judge asking to have the provision removed and they told me today i have a hearing for it this month. me and the children are living in missouri and have been here for almost a year and they are doing great. but i dont have the funds to go to fl for the hearing. any suggestions ?

It would be a very wise decision to retain counsel to represent you in getting out of this mess your husband put you in. You can motion the court to appear by telephone but the judge
will have to determine if that is alright. You might want to contact the Judicial Assistant to see if you can fax her a motion to appear telephonically and provide your reason for same.
