constructive trust

I live in WV. I was divorced in FL in 2008. A farm that has been in my moms name since 1999,and in the divorce papers it stated that if said property was sold ex spouse would get 50% of the sale etc.Can this property be sold under a constructive trust if I don't cooperate with a mediation brought on by the ex? Just curious!!!!!!!!!!!!
