    Default Child support question?

    Hello! I have a few questions. My boyfriend had been paying his child supporticon thru personal checks to the x. He had it switched over a couple monthes ago to child support enforcement in order to avoid the contact with her. She is very violent and threatning. She received $1500 personal check every month from him, she started threatning that she would say she never got it. She then filed a judgement in December against him for $4000 back child support. He went and fought it being we had the copies of the checks she had cashed. The judgeicon reissued a new IDO saying that he had paid that amount and it should be forgiven. Apparantly child support enforcement did not receive this new paper. She then called his payroll person at work and told them that they need to take out 65% more out of every check. So now the work is taking out the 65%, and now that he filed his taxes, and being child support enforcement is so backed up they have not received the new papers they are garnishing the $4000 out of that. We do have a new IDO and court issued paperwork that the $3000 is forgiven and $25 should be taken out each pay period until taxes come in, then one month child support will be taken out of taxes, minus the $25. This is not being followed, what can we do? What legal ground do we have to stand on? He is getting drained out of everything and getting lead to dead ends. Dianne

    In IDO has nothing to do with the total amount owed. All it does is allow a paycheck to be garnished. There must be a separate order stating the amount of arrears and the monthly amount going forward. The Dept of Revenue, child supporticon Enforcement is large, inefficient, and makes mistakes. A private attorney would be a better choice to figure out and correct mistakes.
