    Default Plaintiff"s Motion for summary Judgment

    Being sued for a loan (15K) that ex-wife was court ordered to pay in Final Judgement of Divorce Decree.

    I answered the complainted, affirming some of the statemets and dening others in the complaint, recivied a "Plaintiffs Motion for Summary Judgement on 1/16/2013. My questions are:

    1. Do i have to cite case law if i file a opposition, and if so Is there any Florida Case Law that I can cite. ( ex-wife was court ordered to pay this debt)
    3. How many days do I have to file a opposition.
    4. If i just do notting what is the worst case that can happen ( Judgement etc ?)

    If you are a guarantor on the debt there is not much you can do. The family law court order does not affect your direct obligation. However, there are possible defenses to any lawsuit. You should consult with an attorney. We can do that for a reasonable cost.



    3. How many days do I have to file a opposition.

    20 days from service.


    4. If i just do notting what is the worst case that can happen ( Judgement etc ?)

    You got it. Judgment and possible garnishment.
