Marital Property?

I want to file for a divorce (4 year marriage). My spouse owned home for 5 years prior to the marriage, and keeps saying he owns it, it's his house and I need to move out, etc. But we refinanced and retitled it three years ago. Is it now marital property? Also, I have two minor children from an earlier marriage that live in the home full time-doesn't this also give me an edge in being allowed to live in the home, for their sake with friends, schools, etc? His 15 year old daughter does live here half time and her mother's home is her "primary residence."
