Custody Issue

My sister and her husband separated and he moved out of state to Atlanta to work. They have a six year old son that stayed with the mother until she took him to visit his father for a period of six weeks. When my sister went to pick up her son, the father would not let her and said the son was going to stay with him. Can he legally do this? and what can she do to regain full custody or even shared custody? She would like her son to stay with her. Her and her husband both earn about the same and both live comfortably so support is not the issue.
