    Unethical Divorce Attorney - Falsified Income

    I have two questions that I haven't been able to get any valid answers for.

    1. Is it considered ethical for an attorney to represent a divorceé with whom he/she has a non platonic relationship. Specifically, Is a Marriage Settlement Valid if the Lawyer filing the document is involved with his/ her client, then two weeks prior to the final hearing hires new counsel?

    2. How do you go about proving a non costiodal parent is falsifing income, by only claiming a portion of actual income (having the employer pay partly on the books and the remainder in cash).

    Number 1 is a question for The Florida Bar but it is probably a violation of ethics. A violation of ethics does not void a Marital Settlement Agreement.

    Number 2 - you need to subpeona the records of the employer.
