    Default CS Modification - Florida

    In a nutshell... (Florida)

    Divorced 98, child was 3 - child is now 14 years old.


    A request of child supporticon modificationicon entered in 2/2007. Yes, 2007... As of today, we are still in the discovery phase. I've provided my ex's whereabouts and not to mention he's a federal employee. He has NOT been cooperative, the G.M. found him in Contempt on Five counts... At my last hearing (which I thought was the Final), I was awarded by Default. Now, after all this time he obtained an attorney and was granted his 7th extension (yes, 7th extension)... the opposing counselor is now requesting Production by me.

    My attorney is asking for more money before filing a motion of objection.

    I am so discouraged and confused by the legal system. I almost feel as the G.M. and my attorney is working against me.... I understand its a process, but when a judgeicon states granted plea by default. The ex has been held in contempt on five counts and nothing has been done to him. I am being told some many different stories from Child Enforcement and than my attorney, I do not know who do believe. Any suggestions????

    Is this the norm, does a modification take this long? I understand my ex has not been cooperative, but I've provided his employer's information, his place of residency and still nothing... Just alot of motions and not action.

    Now, to be asked to borrow or beg for an additional thousand dollars to move forward seems to unfair....

    Any suggestions... please!

    Unfortunately, in our legal system, there are many opportunities to delay and harass. Yes it is unfair. But your attorney works for a living and he is the one fighting against the unfair tactics.

    You just have to work with the way it is. The justice system is not necessarily perfect but it is all we have.

    Another $1,000 is low in the grand scheme of things.

    I know this is not what you wanted to hear.
