    Default Alimony Calculation - layoff impact

    What effect does a job loss have (paying spouse) to the calculation of alimonyicon?

    13 yr marriage, husband 80% of household income, wife 20 %

    Does the regular salary go into the calculation? As his normal salary?

    If the loss of work is involuntary - that will be a basis for a downward modificationicon in alimonyicon.

    Default Layoff modification of alimony

    , layoff was involuntary, and alimonyicon not yet set.. Reason to believe now he is voluntarily not pursuing gainful employment for the past 4 months.

    Since alimony not yet set, should the spouse need to demonstrate he is seeking gainful employment ?

    Should his normal salary for his field of expertise (engineering) be a factor?

    If he is not making a good-faith effort to seek employment - that is still considered voluntary underemployment. But you must prove it.

    You may want to consider bringing in a vocational evaluator. They cost between 1,000 and 2,000 and can support a case for alimonyicon.
