    Default Visitation

My divorce agreement specifically states that I am allowed to move out of state with my son. I've already notified my ex of my intent to move but I'm not sure what the legal process is for this. Do I need to file this with the court? Also, can my ex stop me from moving even though it was agreed upon in our divorce?

If your divorce agreement is specific on that issue - you are free to leave. You don't need to do anything else because the court order already allows a move.

You spouse can try to make trouble - but it probably won't succeed because your final judgment provides for relocation.

Thank you for the response...one follow up question? Can the move be held up because of a disagreement in visitation? Ex wants to alter the arrangement and has requested mediation.

It can always be held up by a court.

If I were you, I would move quickly. Ultimately, a court will not decide your move was wrongful because your final judgment allows relocation.
