    what is the best way to begin the divorce proceedings in a case where marriage is in orange county, where I reside, she is in Illinois, there is no children or property, very minimal personal belongings to squable about. Please keep in mind when you respond that she would be uncooperative to say the least. It concerns me when you say that even though she has established residency in another state that she still has rights to my dwelling, how can I change that while awaiting marrige disolution?     You can file a Petition for Dissolution in your county and pay a Illinois process server to serve the Petition and Summons.

    I doubt there will be issues on your residence if she lives in Illinois. Whether she has ownership rights or not will depend on your facts as applied to Florida law.
