My husband and I have a pending divorce (file date 04/03/2007) no children or property. He has finally agreed to settle and wants to settle before mediation (mediation is set for 08/26/2009). He had an attorney, but no longer wants to pay any additional attorney fees when we can possibly do it ourselves. Are there any forms we can file to show we are in an agreement (at this point we are fighting over nothing) and mediation is not needed?

I might be much more simple to go to mediation. He can instruct his attorney not to attend.
The advantage to you is that the mediator will use his or her expertise to write the agreement. The mediator will then submit the agreement directly to the court. That is my recommendation for you. Attorney Howard Iken The Divorce Center |
