    Default what to do about filing joint taxes

    Husband's just filed for divorce.I have to fill out financial affadavit and comply with mandatory disclosure before Aug 15. We have until at least Aug 15 to file our 2008 taxes. We've always filed jointly; it's to my financial benefit to do that again (if he'll sign them). We are not in contact. I might be able to get him to sign them by emailing him and/or showing up where I know he'll be or give them to someone else and have them meet him or ask him to go to the accountant (he may not be able to do that). What should I do? Seems like I should try to get them signed sooner than later.

    Do I provide IRS returns for 2006, 2007 and just the W2s etc for 2008 OR hurry and file 2008 together so I have 3 yrs of returns by Aug 11th?
    Thank you for your advice! This is pretty confusing.

    Yes, you provide what you have. The 2008 is not required if it has not been filed. On the Certificate of Compliance - state that 2008 has not been prepared and filed.
