Current Income of either Spouse and Alimony Decisions

    Ability to pay of one spouse and Need of the other spouse.  That is one of the most important questions and the answer is based heavily on how much each spouse earned. 

   A good rule of thumb:  if one spouse earns twice the income of the other, the possibility of alimony is increased.  Three times the salary and alimony becomes probable.  Again, the other factors will always weigh into the decision.

Common questions and answers

My spouse hides income.  What now?  The hard reality is that proving hidden income is sometimes difficult.   Especially if your spouse works "off the books."  Sometimes, a look at the bank statements can reveal hidden income.  Or you can ask the court to "impute" income.  This means the court will assign an income to your spouse even though the money never appears.

What if I plan to retire soon ?  Alimony can be modified any time income significantly changes.   The Florida Supreme Court has previously ruled that people have the right to retire.

What if my spouse refuses to work and earn an income?  The purpose of alimony is not to allow someone to avoid work - if they are perfectly capable of working.  But you must be realistic.  A 58 year old spouse that has been married for 20 years and has not worked for 10, will not be able to develop a new career from scratch.
