    Evidence of domestic violence or a conviction of domestic violence will work against a person seeking custody.  Florida law specifically directs judges to consider domestic violence in their custody decision.  Also, because a judge must determine the "best interests of the child" in any custody determination, signs of domestic violence weigh in favor of granting custody to the "non-guilty" party.

   For this reason, if you are competing for custody of the children in a divorce, always be aware that other unrelated proceedings can work against you.  For example a Domestic Violence Injunction against you may destroy your chances at gaining custody of your children.
