    Default child visitation

    this is where i am. me and my wife were fighting i left to go hang out with my father. the next day when i was going to come home she said i cant. and she wants a divorce. her mom moved in that same day. even tho her name was the only one on the lease i knew i could go back. and pry still can. but i dont trust her mom and the lies she can come up with and i dont want them trying any legal problems on me that will hurt me in the divorce. do you think this will hurt me to fight for my daughter sense im not there. also she wont let me talk to my daughter and i pry seen her one hour a week sense this started 3 months ago. is there anything i can do to have to court order visitation before anything. what step of the divorce process would it fall under. one more thing i hear that her acting like this will just hurt her chances more is that true

    First of all, you need to file for divorce to get the action into court so you can have the court establish a visitation schedule. I would not try to force your way into the house as that may give her grounds to file for something like a restraining order.

    Depending on what county you are in, you may be able to get an emergency hearing for to establish visitation. The courts look at many factors when determining the best interest of the child and one of the factors is the parent who will help foster a relationship with the other parent.
