    Question Why did they give them back

    Divorced 2 1/2 yrs. CPS has been called on the CP (mom) several times due to sitters who made my children smoke cig., the school nurse called because the CP hit my daughter in the head so hard she could not concentrate. The latest is because the sitter beat my children and left bruises and liner marks that lastest for days. Was awarded an emerg DVI - for a month. During that time, the children improved in school. No referrals, no aggressive behavior toward others. But the courts gave them back to her and they have been going backwards ever since. Referrals - aggressive behavior - hitting children in the privates. Hitting children and staff members at the day care. Has already been expelled from one because of this and is in danger of it again. The CP and her paramour have both tested pos. for THC documented in CPS and referrals were made for her and kids. Never followed through with. What are my chances if I fight for them full time since CPS didnt feel that it was necessary to change their residence?

    If CPS has not filed a case - you are free to try to modify your last judgment in domestic relations court. I would say you have a good chance.

    Thank you for your response. One more quick questions. When I file the motion, do I provide all the documentation at that time that I have for the judgeicon or magistrate to review or do I hold on to it and present it in court?

    And sorry - this is in Florida... Pasco County.
