    Default Custody battle in divorce?!

    First question. My husband, who is being chaptered out of the army for 6 offenses. (1) AWOL (2) Breaking a direct order (3) Broke a military protection order twice (4) Destruction of Govt. property - which included a window and 2 doors in our home (5) Told his first Sgt. F**K you (6) Felony assault,which I was and still am currently pregnant...

    He has a lawyer to represent him since he is currently incarcerated...

    Does he have ANY chance of getting custody??

    Also, we have furniture that is in BOTH of our names because we got it financed. I have made all the payments...How will that be handled??

    You should hire an attorney if you are considering divorce or simply custody issues (as you seem to have a lot going on with his charges etc.). He will more than likely not get majority timesharing with the child(ren); you will more than likely get the majority of the timesharing. If you want sole parental responsibility or ultimate responsibility as to decision making for the child(ren) due to his offenses you need to establish that shared parental responsibility would be detrimental to the child(ren). As for any debt (credit card, furniture, etc.) that came during the marriage - it should be shared equally. Keep track of all the marital debt you are paying off and ask for an unequal Equitable distributionicon at the close of the case.
