The Court Docket was in error, could not hear my contempt
Went to Court on Jan 19th. Apparently my ex set up hearing for 2:00pm for her motions of Rejection to General Magistrates Recommendation which held her in contempt and told her if she did not follow visitation, they would give majority of shared parenting
to me. I filed motion of contempt and change of visitation after the General Magistrates hearing. When I asked for hearing which is done on email to Judges' Asst. , she put all the motions and my ex's together at 2;30pm on same date for one hour. When I arrived they where leaving. Apparently, the Assist. even after confirmations from her about the time and dates..., she never put on docket and the ex's first hearing time was. So therefore, the judge
said i did not show up, which was changed. i arrived at 2;15, and the Bayliff brought me in and showed the emails and documentation from the Asst. The Judge changed it so it would not appear that I did not show up. First. How do I get a copy of this. I did see him do this...Second. The Judge said I can re do my hearing for the Contempt and Change of Visitation but She was suppose to supply a transcript of the General Magistrates hearing which she did not.
Apparently we will have to go before a new judge since Judge Stevens is moving out in Tampa. Judge Thomas takes his place. The Judge Stevens said, we can call Mon and request a new hearing and ask them to expedite the date....and that I can stillhave my motions heard for the Contempt etc.
Can she still have hers heard ie: Rejection to the General Magistrate, Contempt on Me for child support
, which I supplied all necessary documentation to the General Magistrate for the Disability. (she doesn't get it).... Filed and have atty for this.
I would like to have representation ....This has been a long time for me. First I have not seen my son for 4 years, then its been the next three in court. Finally received a complete Shared Parenting Visitation, it lasted three months, since, cannot see him. Since Jan 25th 2009. Will not return calls. And I have to go through her new husband...which he may not call back. I did get to see my son for xmas for several hours at my sisters house. but before that almost two years. The Judge did tell her that she had to follow the Visitation Order. But she still will not.
Any comments please. Sincerely appreciated. I want custody of my son. Please. he calls her new husband Dad.......
