are public benefits consider as income in child support
hearing? my ex recieves unemployment benefits $700 per month. Medicaid for my children and food stamps and housing assistant.. I used to make $650.00 per month for the past two years until recently I was laid-off.. I have been paying what ever I can since 2007 I have been order to pay $425 per month for 2 children. what payments should I be making by law?

The court will take into account public benefits and any monies allocated for the children through the government based on your circumstance. However, if child support
was previously ordered and there has been a substantial change in circumstance (i.e., unemployment, etc.) then you MUST immediately file a Supplemental Petition to Modify Child Support and have the other party served personally. The court will ONLY go back to the date of the filing of this document when calculating any arrears and not to the date of the incident. The other party may come to an agreement with you though about any arrears.
