    Default Answer to petition for modification of child support and to have child support taken

    I need to answer the above. The ex-husband is going to flip when I don't agree as he's trying to get a reduction in child supporticon retro active to my oldest son's graduation in June 2010. This child turned 18 March 2011 and the petition is just filed now in April. I'm reading that federal law doesn't allow for retro active support up/down but as of the date of mod. filing?????

    Also, he thinks that the support payment is simply cut in half and is asking for this amount without attaching the Guideline Worksheet. Our original divorce agreement states he is to furnish me a copy of his income tax each year which he has not. Will the judgeicon throw out his petition or do I just disagree without stating the obvious????? Do I need to attach the worksheet with my current income????? I think this would be the most fair and in the best interest of the one remaining minor child.

    Lastly, I'm trying to keep the peace and not start world war three....

    Support will be retro to the 18th birthday because he already graduated from HS. State law governs, not federal law.

    When there are no attorneys on either side, the judgeicon normally calculates guidelines support. Just go with the flow. You cannot get the case thrown out if there is a legitimate claim for modificationicon.
