    Default change in custody

    Hi Howard.
    I'm friends with Tom Lemons. I was at his documentary unveiling a few weeks ago.
    Anyway, I have a 14 yr old daughter whose father has primary custody. It was a decision that he and I came up with when she was about to go into kindergarten.
    This past school year, we moved her to a better school which happened to be closer to my residence. With this being said, she's spent most of the time with me (he gets her Thursdays and alternating weekends).
    She doesn't want to live with him anymore. In reading the previous threads, is it really pointless to file for a change in custody if the judgeicon doesn't really take a child's thoughts into consideration?

    You have a different situation.

    If the pattern has already changed, and that pattern appears to be permanent - you have grounds for modificationicon.

    It is never pointless - just more difficult than the original case.
