    Default how many years does the court look back for income

    my nephew worked 40 hours and overtime to support his family
    his wife never worked except to watch a family members child and that mother paid her under the table. that was never claimed on their income tax during the one year they were married or her previous years of living with him. they have a 6 year old girl
    question: how far back does the court look at income to establish support
    and
    it does not seem reasonable that the wife could get away with working very little or not at all and my nephew would have to pay the most support when she is a lazy person.
    is it not 50/50 when you pay for a child's expenses

    In order to calculate child supporticon now they will use each party's current income and the amount of overnights the child(ren) is with each parent. If a party is covering health insurance for the child that amount will go into the equation also. The court usually requires the parties to share 50/50 the uncovered health and medical expenses but sometimes orders this to be paid pro rata (higher percentage for higher income earner).

    does the court look at the current 3 months of salary or does the coourt look at the past year of income, or two years of income?

    That is up to the argument of both parties. Any of the choices is valid. If no argument is made the the most recent months would be the default.
