Alimony Abuse and Visitation
First off I would like to say that I enjoy reading your posts and advice.. Very clear and great information..
So, I really have a 3 part question that involves 1.) alimony
payments not used to pay the mortgage and subsequent forclosure action. 2.) Can Non Modifialble Rehabilitative Alimony be modified or cut off due to abuse 3.) Visitation with minor children being denied.
1.) I have been divorced now for about 4 1/2 years and technically have 12 months of Alimony left to pay. My ex recieves plenty of Alimony to cover the mortgage on the former marital home that was Quit Clam Deeded to her in the final court order, (yes I have since found out that my attronies ill advice has been detrimental to my credit). Between 2008 and 2009 she failed to pay the mortgage for 14 months and the home was placed into foreclosure action. In 2010 the Foreclosure was tossed out and the Mortgage was placed back as original. I was advised this morning that the mortgage once again has not been paid in over 7 months and Foreclosure action has once again been started. Q: Is there anything I can do to protect myself in this matter?
2.) I would like to know if there is anything I can do with regard to stopping the Alimony Payments or adjusting the amount since my ex is obviously abusing the Alimony payments she recieves. I find it appalling that she can recieve more than $1,000.00 per month more than the monthly mortgage payment and is not required to pay it.
3.) I currenlty live out of state but will be relocating back to Tampa in July. We have shared custody of the minor children. I had a conversation with my ex a few days ago and advised her that I was relocating back to Tampa and would like to set up my visitation for the summer and discuss the future and our shared custody. She has now decided that she is going to refuse my Court Ordered Summer Visitation and has also decided that she is not going to adhere to the Final Court Order of shared visitation and will only allow me to see my children every other week end. Q: I know I have rights per the court order, will me taking her back to court help at all??

You can file a Motion to Enforce as to the time sharing and as to what the alimony
payments are supposed to cover.
You can consider a Rule to Show Cause addressing the mortgage and alimony issue.
Might need a consultation in person or over the phone to go into more detail.
