    Default New Alimony Law

    The new alimonyicon law....I was awarded permanent periodic alimony in 2008,my part of the exs FRS retirement,and I earn about 1000 per month,what I was earning at the time of the MSA,nothing changed.. Will my alimony stay in effect???my ex has retired early(55) and trying to modify alimony because of the early retirement, will the courts imput an income to him???He is pastoring a church saying he isn't paid but from looking up pastor incomes he could earn up to 75,000 per year at a big church. He can also go back into law enforcement and get a second pension plan after I think a month of real retirement from the FRS..Our marriage was almost 3 decades long.... thanks so much for your answers..knowledge is really as you say power...Thanks again,have a great day...

    That retirement age sounds a bit early. The courts will probably treat him as "voluntarily underemployed." That means there is a high chance the court will impute his income at his prior earning level.

    But keep in mind, you may have to properly argue or prove necessary points for the court to impute income. It is a complicated issue.
