    Default child endangerment

    If you have proof that the other parent is texting and posting to facebook while driving on a regular basis, is it appropriate to file a contempt motion for child endangerment? The statistics show that those activities are more dangerous than driving drunk. I'm very concerned about my children's safety because their mother literally lives on facebook. Would it be appropriate to subpoena phone records to show the volume of text messages when I know for a fact that she is en route for a two-hour drive with my children? This drive occurs twice a week, so there is plenty of history.

    Yes, I thing records matched up with driving times would be good.
